All orders on the Site are subject to these General Terms and Conditions of Sale. These are subject to change and update, the conditions applicable to the order of a product by a customer are those in force on the day of the order. These General Terms and Conditions of Sale are subject to French law.

OBJECT:

The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale shall prevail over any other general or specific conditions not expressly agreed to by Klose Jewelry.
Klose Jewelry reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer. It is therefore up to the Customer to refer to them during each order validation. The nullity of a contractual clause does not entail the nullity of the General Conditions of Sale.

PRODUCTS AND SERVICES OFFERED

The products and services offered are those listed in the catalog published on the Klose Jewelry website.

The descriptions and photographs of the Products sold on the Site are as accurate and faithful to reality as possible. However, the colors, dimensions, textures and other characteristics of the Products may be altered by the screens or internet browsers used to view them.

These products and services are offered while stocks last.

In the event of unavailability of the products after placing the order, the Customer will be informed by email or telephone as soon as possible. Klose Jewelry will offer to supply a similar product at the same price. In the absence of acceptance, and if the payment has already been debited, it will proceed to reimburse it within a maximum period of fourteen (14) days.

THE ORDER

In order to place an order, the Customer agrees to communicate via the Site, the real and valid information necessary for the execution of the service covered by these General Terms and Conditions. Klose Jewelry cannot be held responsible for incorrect information transmitted by the Customer resulting in the non-execution of the service covered by these General Terms and Conditions.

The order form contains information on the essential characteristics of each of the products ordered: price, means of payment, delivery terms. The contract is concluded when Klose Jewelry receives the online order form and once the accuracy of the data relating to the order has been verified.

Confirmation of the order entails acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of relying on one's own conditions of purchase or other conditions.
All data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out.
The seller will communicate by email confirmation of the registered order.

Klose Jewelry will be entitled to refuse any order placed by a customer with whom there is a dispute relating to the payment of a previous order as well as any order not in accordance with these General Conditions of Sale.

The permanent or temporary unavailability of a product shall not in any case engage the responsibility of the Seller and shall not entitle the Customer to compensation or damages. After validation of the order by the Seller, the Customer receives a confirmation by e-mail.

No exchanges can be made. Following receipt of your return, we will refund the jewelry, excluding shipping costs.

PRICES AND PAYMENT TERMS

The prices listed in the catalog are inclusive of all taxes in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.
Klose Jewelry reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.

Payment is made by credit card (CB, Visa, MasterCard, American Express). The Customer's credit card is debited at the time of validation of the order for the full amount and the amounts paid cannot at any time be considered as deposits or down payments.

In the event that the debit of the amounts owed by the customer proves impossible (opposition, bank refusal, etc.), the order will not be recorded by Klose Jewelry. The information relating to the Customer's bank card and communicated by the latter on the Site constitutes authorization for Klose Jewelry to debit his account for the full amount of his order.


The prices indicated do not include order processing, transport and delivery costs provided that they take place in the geographical areas provided for below.

GEOGRAPHICAL AREA

 

The online sale of products and services presented on the site is reserved for buyers who reside in France, the French overseas departments and territories or Monaco and for deliveries required in these geographical areas.

In the event of delivery of a product outside the territory of the European Union and in the French Overseas Territories, the Buyer declares himself the importer of the product and accepts that in such a case Klose Jewelry may be materially unable to provide him with exact information on the total amount of costs relating to customs duties and formalities or import taxes applicable in the country where delivery of the product is requested.

Unless otherwise stated on the site during the ordering process or in the description of the products ordered, Klose Jewelry undertakes in all cases to deliver the products within a maximum period of thirty (30) days after the conclusion of the contract with the buyer.

DELIVERY

Orders placed on the website wwwklose-jewelry.com are shipped within 24 to 48 hours from Monday to Friday. Orders placed on a Saturday, Sunday or public holiday will be processed the next business day.


The risks are the responsibility of the purchaser from the moment the products leave the premises of Klose Jewelry. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.

Klose Jewelry is not responsible for packages that go missing after official deposit recorded by the carrier. Once your package is declared delivered, our responsibility is no longer engaged. No refund will be made in this case.

The Customer is solely responsible for any failure to deliver due to a lack of information when confirming the order.

The Customer must check the condition of the jewelry in their order and report any reservations to the carrier (Post Office or other) in the event of a missing or damaged item.

Delivery times vary depending on the delivery method chosen. They are indicated to you on the site when you validate the delivery method. Klose Jewelry undertakes to inform the customer by email of the progress of their order (preparation and shipping).

Delivery times are given for information purposes only; if they exceed thirty (30) days from the order, the sales contract may be terminated and the buyer reimbursed.

For deliveries to a relay point, the package must be opened and checked before signature.

After validation by the customer's signature, no complaints will be possible.

For any other delivery method (carrier, courier, etc.), please contact Klose Jewelry directly, who will do everything possible and reasonable to satisfy the Customer.

THE RIGHT OF WITHDRAWAL AND RETURN PROCEDURES

To make a return, you must send an email to customer service at the following address: client@klose-jewelry.com to inform us of your return and obtain the necessary information. Without this email, your return will not be accepted. Returns are possible within 14 days of receipt of your order.

Our teams will check the condition of the jewelry before proceeding with a potential refund. Earrings / piercings are not subject to a possible return for hygiene reasons. When the right of withdrawal is exercised, we reimburse the buyer for the full amount paid. Returns are the responsibility of the customer. Jewelry must be intact, not worn and returned in its original packaging so that it can be resold in new condition.

Klose Jewelry reserves the right to refuse reimbursement of the returned Product in the event that the conditions mentioned above are not respected.

Any customs charges related to the return of a product from a foreign country are also the responsibility of the Customer.

Klose Jewelry strongly advises its customers to return the products by Lettre Suivie or Colissimo. The Customer also has the possibility to choose the carrier of his choice. However, the return costs as well as the associated risks are the responsibility of the Customer. It is therefore recommended that he arrange for proof of this return, which assumes that the products are returned with parcel tracking, or by any other means giving a certain date.

Returned Products must be sent to Klose Jewelry in a single shipment. Klose Jewelry reserves the right not to accept items from the same order that are returned and shipped at different times.

Sales during the sales period, Ephemeral items (Advent calendar) or other commercial offers are neither exchangeable nor refundable.

REIMBURSEMENT DEADLINES AND METHODS

If the right of withdrawal is exercised in accordance with the terms and conditions indicated above, Klose Jewelry will take the necessary steps to reimburse any sums already collected for the purchase of the products within fourteen (14) days after receipt and verification of the condition of the products.

In the event that there is no correspondence between the recipient of the products indicated in the order form and the person who made the payment of the amounts due for the purchase, the refund of the amount will be made to the person who made the payment.

Reimbursement will be made primarily by crediting the bank card debited during the purchase on the e-shop.

GUARANTEE

For any complaints about your order, please contact customer service by email client@klose-jewelry.com within a maximum of 72 hours upon receipt of your package.

The warranty is no longer valid after 30 days from the date of receipt.

All products supplied by the seller benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code .

Under these guarantees, it may be returned to Klose Jewelry, which will offer the Customer either a refund or an exchange of defective products or those that do not correspond to the order.

In order to ensure rapid and quality processing of the warranty request, the Customer will specify their contact details, their order number and the reference of the item concerned and will detail as much as possible the problem encountered and, where possible, will attach to the email a photograph of the product defect.
Any claims for an order will be impossible after 30 days from the invoice date.

In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, we offer a consumer mediation system. The selected mediation entity is: CNPM - MEDIATION DE LA CONSOMMATION. The Klose Jewelry brand as well as all figurative or non-figurative brands and more generally all other brands, illustrations, images and logos appearing on the Goods, their accessories and their packaging, whether registered or not, are and will remain the exclusive property of Klose Jewelry. RESPONSIBILITY

The seller, in the online sales process, is only bound by an obligation of means; his liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other involuntary problems.

COMPUTERS AND FREEDOMS

The Customer is informed that the data he provides on the Website is subject to various automated processing of personal data.

DISPUTE RESOLUTION AND APPLICABLE LAW

These general conditions are subject to the application of French law. The competent court is the judicial court. It is thus for the substantive rules as for the rules of form. In the event of a dispute or complaint, the buyer will contact the seller as a priority to obtain an amicable solution.
